2. Bookings and Reservations
Availability, pricing, minimum stay requirements, house rules, and other rental terms are subject to change until a reservation is confirmed. By submitting a booking request or completing payment, you represent that the information you provide is accurate and that you are authorized to make the reservation.
Confirmed reservations may be subject to additional rental agreement terms, cancellation policies, security deposit requirements, and property-specific rules provided at or before check-in. In the event of a conflict between these Terms and a signed rental agreement for a specific stay, the rental agreement will control with respect to that stay.
3. Payments
Payments may be processed through third-party payment providers, including Stripe and Intuit QuickBooks Payments. ACH payments processed through QuickBooks are provided by Intuit Payments Inc. By submitting payment information, you authorize us and our payment processors to charge the payment method you provide for the amounts due, including applicable taxes, fees, and authorized additional charges related to your reservation.
You are responsible for providing current and accurate payment details. Failed, reversed, or disputed payments may result in cancellation of a reservation or suspension of access to booking services.
4. Cancellations and Refunds
Cancellation and refund eligibility depend on the cancellation policy applicable to your reservation and any signed rental agreement. Unless otherwise stated in writing for your specific booking, fees may be non-refundable after confirmation. Contact us promptly if you need to modify or cancel a reservation.
5. Intellectual Property
The Services, including text, images, logos, design, software, and other content, are owned by Private Beach Paradise or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Services without our prior written consent.
6. Third-Party Services
Our Services may integrate with or link to third-party platforms and payment providers, including Guesty, Stripe, and Intuit QuickBooks. Your use of those services may be subject to separate terms and privacy policies maintained by those providers. We are not responsible for third-party websites, services, or policies.
7. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation of the Services.
8. Limitation of Liability
To the fullest extent permitted by law, Private Beach Paradise and its owners, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, including lost profits, lost data, or business interruption. Our total liability for any claim arising from the Services will not exceed the amount you paid to us for the reservation giving rise to the claim, except where such limitation is prohibited by law.
9. Indemnification
You agree to indemnify and hold harmless Private Beach Paradise and its owners, managers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your misuse of the Services, violation of these Terms, or violation of any rights of a third party.
10. Governing Law
These Terms are governed by the laws of the State of Hawaii, without regard to conflict-of-law principles. Any dispute arising under these Terms will be brought in the state or federal courts located in Hawaii, and you consent to their jurisdiction.

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the Terms were last revised. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
